Biography

Jennifer A. Maged is an Associate with WKWilburn P.C. She specializes in federal and state government construction contracting, construction and commercial litigation, and insurance law.

For over 15 years, Ms. Maged has successfully counseled corporations on construction contracting, the Federal Acquisition Regulation, commercial transactions, liability and insurance issues, and federal and state audits. Her government contracting and construction law experience includes several years as an Assistant Attorney General for the State of Maryland, advising the Maryland Stadium Authority. These duties included application of State procurement regulations; and participation in major government construction projects, including new construction of an indoor sports arena, design and development of a conference center, and complete renovation of an historic theater.

In her insurance practice, Ms. Maged has successfully advised project owners, general contractors, subcontractors, and insurers with regard to their builders risk, errors and omissions, and commercial general liability policies. She also litigates insurance coverage disputes and defends construction clients against defective claims actions.

Ms. Maged has first-chaired numerous bench and jury trials in state and federal courts in Maryland and the District of Columbia; and appeals in state courts and the Fourth Circuit. She has counseled clients in administrative proceedings, mediations, and arbitrations; and has served as a mediator in Maryland state court proceedings.

She is a Panel Member of the Maryland Attorney Grievance Commission. The Commission is appointed by the Maryland Court of Appeals and adjudicates ethics violations and professional conduct complaints against lawyers. Ms. Maged is serving her second term as a Panel Member.

Significant Cases

Smart v. State Farm Mut. Auto Ins. Co., 126 Md.App.511, 730 A.2d 690 (1999)(involved narrow issue of insurance policy interpretation)

Won jury verdict for utility company in construction dispute. Verdict was five times greater than opponent's highest settlement offer.

Won state court bench trial verdict recouping money owed to construction client under Maryland Miss Utility law (contractor's statutory duty to locate underground utility lines), breach of contract, and indemnity claims.

Favorably settled multi-party, consolidated litigation for general contractor arising out of complete renovation to historic property in District of Columbia. Multiple insurance coverage, liability and breach of contract claims were resolved in complex, global settlement.

Won summary judgment in errors and omissions insurance policy coverage dispute, indemnity claims and fraud counts in complex joint-tortfeasor action.

Won summary judgment in multi-count insurance policy coverage dispute, saving client from extensive attorney's fees and court costs.

Won numerous bench and jury trials in state and federal courts on a spectrum of issues, including Miss Utility statutes, breach of contract, property damage recovery, premises liability, motor vehicle liability, contribution and indemnity, and appeals of administrative proceedings.

Won numerous dispositive motions in state and federal courts, including assumption of risk, statutory violation establishing negligence per se, judgment on civil fraud counts, dismissal of claim for punitive damages.
